While back in his home state, he turned his focus towards addressing pressing social and community issues. His initiatives led to the establishment of various impactful organizations, including Espanola HELPS (HIV Education Longevity Prevention and Support), La Tierra Montessori School of the Arts and Sciences, Espanola Pathways Homeless Shelter - the first homeless shelter in northern NM, and Moving Arts Espanola, which received the 2019 CNN Hero award.

In 2020, Montoya achieved another significant milestone by being elected to the New Mexico House of Representatives, representing district 40 in rural northern NM. His election marked a historic moment as he became the first openly gay and HIV+ positive member of the body.

Since then, Montoya has emerged as a prominent rural advocate in New Mexico, spearheading landmark legislation to bridge the gap between rural and urban communities, striving to bring positive change and equity throughout the state.
